These Terms of Use are an agreement between you and WYNTHAM LTD concerning Music Rhythm Trainer (the “app”) and this website. By using either, you agree to these terms. If you do not agree, do not use them.
1. Personal music practice
Music Rhythm Trainer is provided for personal music practice and education. You may use the app for that purpose in accordance with these terms and any applicable app-store rules.
2. Your responsibilities
You agree to use the app and website lawfully and not to:
- interfere with their operation, security, or availability;
- attempt unauthorised access to systems or information;
- use automated means to overload, scrape, or disrupt the website;
- copy, modify, distribute, sell, or commercially exploit proprietary parts of the app except where open-source licences expressly permit it; or
- use the app or website in a way that infringes another person’s rights.
3. Practice safely
Take regular breaks and stop if tapping causes discomfort in your hands, wrists, or arms. The app is a music-training aid, not medical, therapeutic, or health advice. Seek appropriate professional advice for any health concern.
4. Timing measurements
Timing accuracy is measured using your device’s audio and touch hardware. Results are a practical guide to progress, not a laboratory measurement, and may vary between devices, settings, and environments.
5. Your local practice data
Practice information is stored on your device and is not backed up to a WYNTHAM LTD server. You are responsible for your device, local data, and any loss caused by clearing storage, uninstalling, device failure, or replacement. See the Privacy Policy.
6. Intellectual property
Except for third-party components identified on the Licences page, the app, website, branding, design, written content, and associated intellectual property are owned by or licensed to WYNTHAM LTD. These terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the app and website. No ownership rights are transferred to you.
7. Third-party platforms and software
Your use of an app store, device operating system, email application, or other third-party service is also subject to that provider’s terms. Open-source software included in the app remains subject to its own licence; where those licence terms conflict with these terms, the open-source licence governs that component.
8. Availability and changes
We may update, improve, suspend, or discontinue all or part of the app or website. Features may change between versions. We do not promise that either service will always be available, error-free, or compatible with every device.
9. No warranty
To the extent permitted by law, the app and website are provided “as is” and “as available,” without express or implied warranties. Nothing in these terms excludes guarantees or rights that cannot legally be excluded.
10. Limitation of liability
To the extent permitted by applicable law, WYNTHAM LTD is not liable for indirect, incidental, special, or consequential loss arising from use of or inability to use the app or website, including loss of local practice data. Nothing in these terms limits liability where doing so would be unlawful, including liability for fraud or for death or personal injury caused by negligence.
11. Ending use
You may stop using the app at any time by uninstalling it. We may restrict access to the website or end your permission to use it if you materially breach these terms or create a security or legal risk.
12. Changes to these terms
We may update these terms for future versions of the app or changes to the website. The revised text and effective date will be published here. Continuing to use the relevant service after the updated terms take effect means you accept them, where permitted by law.
13. General
If any provision is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision is not a waiver. These terms do not create a partnership, employment, or agency relationship between you and WYNTHAM LTD.
